Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Khunti P.S. Case No.06 of 2014, corresponding to G.R. No.09 of 2014, for the alleged offences under Sections 413, 414, 34 of the Indian Penal Code and Section 4(i) of MM (D.R.) Act and Sections 4(i) / 54 of the Jharkhand Minor Mineral Rule, 2014 and also under Section 21 of the Air (Prevention & Control of Pollution) Act.

Two trucks, loaded with illegally mined sand were apprehended and the petitioner has been made accused alleging to be owner of one of the apprehended trucks.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and registration document of the truck has been brought on record, which shows the name of other person to be the owner of the truck.

The same stand was taken by the petitioner in the Court below also, as is apparent from the impugned order.

In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, it is directed that in the event of surrender / arrest, the petitioner Bablu Sardar @ Trilok Singh @ Babbu Sardar shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount of each to the satisfaction of learned Chief Judicial Magistrate, Khunti, in connection with Khunti P.S. Case No.06 of 2014, corresponding to G.R. No.09 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
