2 17-05-2018 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks pre-arrest bail in connection with Barun P.S. Case No. 61 of 2018 registered under Sections 379, 411, 420 read with 34 of the Indian Penal Code, 4 and 40 of the Bihar Minor Mineral Concession Rule and 15 of the Pollution Act.
It is submitted by the learned counsel for the petitioner that the petitioner being the owner of the tractor bearing Registration No.BR-45GA/0388 cannot be held responsible for carrying sand without challan and GPS. He Patna High Court Cr.M isc. No.29636 of 2018 (2) dt.17-05-2018 2 submitted that the petitioner has got clean antecedent and his implication in the present case is only because he happens to be the owner of the tractor which was plying on hire Keeping in mind the submission made above and the nature of allegation, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 61 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C.
