IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH Civil Writ Petition No.22119 of 2012 (O&M) DATE OF DECISION: November 07, 2012 Amarjit Singh and others .....Petitioners versus State of Punjab and others .....Respondents CORAM:- HON'BLE MR.JUSTICE A.K. SIKRI, CHIEF JUSTICE HON'BLE MR. JUSTICE RAKESH KUMAR JAIN, JUDGE Present: Mr.Sherry K. Singla, Advocate for the petitioners ..
A.K. SIKRI, C.J.: (Oral) The State Pollution Control Board has given the consent and rejected representation of the petitioners herein, holding that the distance of the rice sheller in question is more than 300 metres from the educational institution. The petitioners are aggrieved by that order and, therefore, present petition, by way of PIL, is filed. However, Section 31 of The Air (Prevention and Control of Pollution) Act, 1981, provides for remedy of statutory appeal against such an order of the State Pollution Control Board which is quasi-judicial in nature. Relegating the petitioners to the said statutory remedy, this writ petition is dismissed.
