The petitioners apprehend their arrest in Barun P.S. Case No.243 of 2018 registered under Sections 379, 411, 420 and 34 of the Indian Penal Code and under Sections 4 and 40 of the Bihar Mines and Mineral Control Regulation Act and under Section 15 of the Pollution Act.

Learned counsel for the petitioners submits that the petitioners are driver and owner of the tractor in question and the driver of the tractor carrying sands on valid permit but the police seized four tractors including the tractor of the petitioner no.2. The permit is annexed as Annexure 2.

Having considered the facts and the nature of Patna High Court CR. MISC. No.13645 of 2019(2) dt.06-03-2019 2/2 allegation made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Barun P.S. Case No.243 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
