ORDER

(Per : HONOURABLE THE CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) In this Special Civil Application the petitioner has challenged an order of closure passed by the Gujarat Pollution Control Board under Section 33(A) of the Water (Prevention and Control of Pollution) Act, 1974.

In view of the decision of the Supreme Court dated August 09, 2012 passed in Writ Petition (C) No.50 of 1998 with I.A. Nos.62-63 of 2011 in Civil Appeal Nos.3187-3188 of 1988, this matter should be transferred to the Green Tribunal as indicated in paragraphs 38 and 39 of the said order.

The office is directed to take appropriate steps for transfer.
