Affidavit dated 13.8.2018 filed by the Chairman, HP State Pollution Control Board Shimla, is neither in consonance nor in the spirit of our order dated 10.8.2018.

At this stage, Mr. T.S. Chauhan, learned counsel for respondent No.1 seeks time to file a better affidavit. Let needful be done within a period of two weeks.

We clarify that we would not hesitate of passing appropriate orders issuing directions to the State for taking appropriate action in accordance with Section 62 of the Water (Prevention and Control of Pollution) Act, 1974 and other environmental laws.

Mr. T.S. Chauhan, learned counsel for respondent No.1 has placed on record communication dated 19 th July, 2018. Conscious of the fact that H.P. Pubic Service Commission is not a party to the present petition, however, finding Mr. D.K. Khanna, learned Counsel, who normally appears for Himachal Pradesh Public Service Commission, we direct him to ascertain the factual position in this regard.
