The issue sought to be raised in the instant writ petition is with regard to inaction on the part of U.P. Pollution Control Board to consider and dispose of a consent to operate application of the writ petitioners dated 15.12.2017 filed under the relevant provisions of the Air (Prevention & Control of Pollution) Act, 1981.

When the matter is taken up for consideration, the learned advocate appearing on behalf of the U.P. Pollution Control Board draws our attention to the order dated 02.01.2018, which appears to have been passed by one R.K. Singh, Regional Officer of U.P. Pollution Control Board.

This order reveals that a decision has been taken with regard to the consent application dated 15.12.2017.

Let a copy of the instructions handed over by the learned advocate representing U.P. Pollution Control Board be taken on record.

Since a decision has been rendered in the matter on 02.01.2018 the writ petition has essentially become infructuous and is disposed of accordingly.
