Show cause notice was issued to the petitioner unit by the Haryana State Pollution Control Board, Regional Office, Panchkula Region, vide letter dated 21.8.2019 (Annexure P7).

According to the impugned order dated 16.9.2019 (Annexure P9), issued by the Haryana State Pollution Control Board, Panchkula, the petitioner Unit has chosen not to file any reply to the show cause notice. In these circumstances, the Regional Officer, Panchkula, on 16.9.2019, has taken action against the petitioner Unit under Section 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and under Section 31-A of the Air (Prevention & Control of Pollution) Act, 1981, to close down the same in response to the recommendation of the Regional Officer, Panchkula, vide letter dated 28.8.2019.

However, in the interest of justice, this petition is disposed of with a direction to the petitioner to file the application before the Haryana 1 of 2 ::: Downloaded on - 07-10-2019 00:15:12 ::: CWP No. 28772 of 2019 (O&M) -2- State Pollution Control Board to obtain no objection certificate within a period of one week, thereafter the same shall be considered by the Haryana State Pollution Control Board within a period of one week.
