Petitioners are apprehending their arrest in connection with Complaint Case No. 635 of 2016, registered under Sections 43/44 of Water (Prevention and Control of Pollution) Act and under Sections 37 / 38 of the Air (Prevention and Control of Pollution) Act.

It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. It is further submitted that the petitioners have neither started their plant nor produced any soft coke as alleged in the complaint case and the petitioners have never violated any of the Rules of Water (Prevention and Control of Pollution) Act and of the Air (Prevention and Control of Pollution) Act.

Learned APP has opposed the prayer for anticipatory bail.

Be that as it may, I am inclined to admit the petitioners on anticipatory bail. The above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender, the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of J.M., 1 st Class, Bermo at Tenughat, in connection with Complaint Case No. 635 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and also on the condition that on the date of surrender, petitioners shall deposit Rs. 30,000/- each in the court below, which shall be subject to result of the case.
