Heard.

The petitioner has come before this Court against the order dated 03.04.2018 passed in Criminal Case No.475/2010 by JMFC, Dharampuri, District Dhar with regard to the charges under Sections 21, 37 and 39 of the Air Prevention and Control of Pollution Act, 1974. The case is initiated on the instigation of the defendant/Madhya Pradesh Pollution Control Board.

During trial of the case, the petitioner/accused requested the Court to accept photocopies of some documents. The learned trial Court observed that these documents are not admissible in evidence as per provision of Section 63 and 65 of the Evidence Act.

Nothing contrary could be brought to my notice as to how the order of the learned trial Court is illegal or incorrect in the eyes of law.

Looking to the nature of the document and observation made by the learned trial Court, I do not find any perversity or illegality in the impugned order. The petition has no merits and the same is dismissed accordingly.
