Mr.Arvind Soni, for the petitioner 

	Counsel inter alia submits that the Board alone is empowered u/s 31-A of Air (Prevention and Control of Pollution) Act, 1981, while order impugned dated 22.7.2009 has been passed by the Member Secretary, to whom no power has been delegated by the authority competent under the Act, 1981. 
	Issue notice along with a copy of this order to respondent. Mr.Akhil Simlote is directed to accept notice on behalf of the respondents. 

In the meanwhile, operation of the impugned order dated 22.7.2009 shall remain stayed till further orders.
