Apprehending his arrest, in connection with Torpa P.S. Case No. 63 of 2015 instituted under sections 414/34 of the Indian Penal Code and also under Section 4(1)/54 Jharkhand Minor Mineral Concession Rules 2004 and under Section 21 of Air (Prevention & Control of Pollution) Act, the sole petitioner, Arun Yadav @ Arun Kumar Yadav has moved this Court for grant of privilege of anticipatory bail.
Heard learned counsel for the petitioner as well as learned counsel representing the State.
The prosecution case relates to seizure of one tractor loaded with 100 cft sand.
Learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged and the vehicle in question was given to the driver and only because the petitioner is the owner of the vehicle, he has been implicated in this case. It was also submitted that the petitioner is ready to pay the tax of the State Government, which is applicable on 100 cft of sand with the fine amount but, the petitioner deserves the grant of privilege of anticipatory bail.
Learned counsel representing the State has no objection. Considering the submissions of the counsels and the allegation, I am inclined to grant the privilege of anticipatory bail to the petitioner namely Arun Yadav @ Arun Kumar Yadav in the event of his arrest or surrender within a period of two weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Khunti, in connection with Torpa P.S. Case No. 63 of 2015 (G. R. 420 of 2015) subject to the conditions laid down under section 438 (2) Cr. P.C. and subject to payment of tax amount of Rs. 320/- plus fine amount of 320/- i.e. in total Rs. 640/-.
