3 08-07-2019 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner is apprehending his arrest in a case registered under Sections 44 and 41(2) of the Water (Prevention and Control of Pollution) Act.
Petitioner is alleged to have running M/s Astha Nursing Home without taking requisite permission from the Bihar State Pollution Control Board with regard to the Bio- Medical Waste Management and Water and Air Pollution.
It has been submitted on behalf of the petitioner that during pendency of the bail application, No Objection Certficate (Annexure 2 series) has already been taken from the Board. It is also submitted that the petitioner is a doctor and he runs the Patna High Court CR. MISC. No.22021 of 2019(3) dt.08-07-2019 2/2 Nursing Home for poor sick people of the society.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below it hin a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Aurangabad in Complaint case no. 5 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
