2 26-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Barun P.S. Case No. 52 of 2018 for the offences punishable under sections 379, 411 and 420/34 of the I.P.C, sections 4/40 BMMCR and section 15 of the Pollution Act.
Allegedly, the informant who was on patrolling duty on 14.03.2018 saw three tractors loaded with sand on Barun- Nabinagar road and seeing the police party all three drivers parked the tractors there and fled away. Three tractors were seized.
Submission is of false implication and that they are Patna High Court Cr.M isc. No.21144 of 2018 (2) dt.26-04-2018 2/2 poor drivers of Chassis No. RAE 008021 corresponding to registration no. BR 45 G 1755 and BR 45H 424 respectively, they have no concern with the loading of sand, co-accused Abhishek Kumar Singh and Pradeep Kumar who are owners of the said tractors have been allowed bail vide Cr. Misc. No. 21278 of 2018 by another co-ordinate Bench of this Court and as such the petitioners also deserve sympathetic consideration.
The learned A.P.P. submits that the petitioners have fled away after parking the tractors.
In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Aurangabad in connection with the aforementioned case, subject to the conditions as laid down under section 438 (2) of the Cr.P.C.
