The petitioner is apprehending his arrest in connection with the case registered under Sections 379 of the IPC and Sections 21(1)/21(6) of Mines and Minerals (developments and Regulation) Act and Section 4(54), Jharkhand Minor Minerals Concession Rule, 2004 and Sections 21(A), 37 of Prevention of Control of Air Pollution Act.
As per allegation the petitioner is running a crusher and stocked 225 cubic fit stone chips and 150 cubic fit dust and it has been estimated that about 17000 cubic fit stone has already been excavated by him and cost of the same been estimated as 1,36,000/-.
Learned counsel for the petitioner has submitted that the petitioner is the owner of crusher and the crusher was closed since long.
Learned APP has opposed the prayer for bail. Be that as it may, I am inclined to admit the above named petitioner on anticipatory bail. The petitioner is directed to surrender in the court below within four weeks and in the event of his arrest or surrender, the court below shall release him on bail on his furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ranchi, in connection with Sikidiri P.S. case No.11/17, corresponding to G.R.No.1206/2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C., and subject to further condition is that the petitioner shall deposit Rs.32,000/- before the trial court at the time of surrender, which shall be subject to result of the case and will not prejudice the case of the petitioner.
