A statement has been given by the learned counsel for the respondents before this Court that under the Air (Prevention and Control of Pollution) Act, 1981, the appellate body has been constituted to hear the appeal under Section 31 of the Air (Prevention and Control of Pollution) Act, 1981 and the appellate body consists of Principal Secretary Law, Additional Secretary, Forest and Environment and Additional Chief Principal Chief Conservator of Forest. According to the respondents, the petitioner has hence an alternative remedy to approach before the appellate authority.
Since the petitioner admittedly has an alternative statutory remedy to approach the appellate authority, the writ petition stands dismissed on the ground of an equal efficacious alternative remedy.
