Pollution Control Board/respondent Nos.2 to 5 and Sri Rishab Kapoor, learned Counsel for U.P. Jal Nigam/respondent Nos.7 and 8.
As per letter dated 17.7.2019 of the U.P. Pollution Control Board, a proposal has been made by the Member Secretary of the U.P. Pollution Control Board regarding grant of permission for running tanneries at the regional level with a stipulation of 50% capacity per unit and directed the District Magistrate, Kanpur to constitute a District Level Committee who shall inspect the Jajmau Tanneries and submit its report so that necessary approval will be granted.
In pursuance of the aforesaid, on 24.7.2019 the District Magistrate, Kanpur constituted 12-members' committee to examine the matter and submit its report.
In view of the aforesaid, at this stage, no order is required to be passed.
As the matter is pending before the learned Committee constituted in pursuance of the order passed by the District Magistrate and after considering the report of the Committee, appropriate orders will be passed by the U.P. Pollution Control Board for running tanneries at the regional level, we expect and hope that the learned Authorities will consider the case of the petitioner in terms of the orders passed by the Apex Court from time to time and the guidelines framed by the National Green Tribunal and after completion of procedure as per Water (Prevention and Control of Pollution) Act, 1974, appropriate orders will be passed.
In case any adverse order is passed against the petitioner, the petitioner is at liberty to challenge the same in appropriate proceedings.
With the aforesaid, the writ petition is disposed of.
