Petitioners are apprehending their arrest in connection with Ormanjhi P.S. Case No. 52 of 2018, corresponding to G.R. No. 2038 of 2018, registered under Section 379 of the I.P.C., Section 21 (A), 31 (A) / 37 of Air Pollution Control Act and Section 54 of the M.M.C.R. Act, 2004 and Section 8 / 9 of the J.M.S. Act, 2007.
Learned counsel for the petitioners submitted that petitioners have been falsely implicated in this case and the co- accused have been admitted on anticipatory bail under order dated 25.08.2018 in A.B.A. No. 4850 of 2018 on certain conditions.
Learned APP has opposed the prayer for anticipatory bail. Be that as it may, I am inclined to admit the petitioners on anticipatory bail. The above named petitioners is directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender, the Court below shall enlarge the above named petitioners on bail on furnishing bail bonds of Rs. 15,000/- (Rupees fifteen thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ranchi, in connection with Ormanjhi P.S. Case No. 52 of 2018, corresponding to G.R. No. 2038 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and subject to the further condition that on the date of surrender, petitioners shall deposit Rs. 5,000/- each in the court below, which shall be subject to the result of the case and will not prejudice the case of the petitioners during trial.
