Learned counsel appearing for the respondents submits that petitioner has efficacious remedy of statutory appeal under Section 31 of Air (Prevention and Control of Pollution) Act 1981.

Learned counsel for the petitioner seeks permission to withdraw this petition with liberty to file appeal, however, he submits that his appeal may not be dismissed on the ground of limitation.

Petition is permitted to be withdrawn with the liberty to file appeal. If appeal is filed within 30 days from today, it shall not be dismissed on the ground of limitation and shall be decided in accordance with law.
