3 09-08-2016 Heard the counsel for the petitioner and the State.
The petitioner apprehends his arrest in Complaint Case No. 02(M) 2012 registered under sections 37(1) of the Air (Prevention & Control of Pollution) Act, 1981 and section 15 of the Environment (Protection) Act, 1986.
In brief, the allegation is that the petitioner, who was running a service centre, was found operating the diesel generator set in violation of the provisions of the Act. It is stated that the court has taken cognizance. Hence the apprehension.
Considering the facts and circumstances of the case, let the petitioner, named above, in the event of arrest/surrender Patna High Court Cr.Misc. No.30852 of 2016 (3) dt.09-08-2016 2/2 within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Patna in Complaint Case No. 02(M) 2012 on condition that one of the bailors shall be his own/close relative.
