2 25.04.2011 Heard learned counsels for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered under Section 379 of the Indian Penal Code Rule 4, 40 and 52 of the Bihar Minor Mineral Concession Rules 1972, Section 4 and 21 of the Mines and Minerals (Development and Regulation) Act 1957, Section 33, 41 and 42 of the Indian Forest Act, Section 31 of Water (Prevention and Control) Pollution Act, Section 21A of the Air (Prevention and Control) Pollution Act and Section 15 of the 2 Environment (Protection) Act.

The F.I.R. has been lodged against 19 persons who are running the crusher without any valid license.

It is submitted by learned counsel for the petitioners that in all the seizure lists, the seizure of two kgs of stone cheap have been made. The seizure list reflects that no crusher machine has been seized.

Considering the nature of seizure which clouds the bona fide of the accusation made by the informant, let the above named petitioners, be released on anticipatory bail, in the event of their arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. Case No. 06/2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
