THE OKLAHOMA REGISTER is an official publication of the State of Oklahoma. It is published semi-monthly on the first working day of the month and on the first working day following the 14th day of the month under the authority of 75 O.S., Sections 250 et seq. and OAC 655:10-15-1. The rules of the State of Oklahoma are codified and published in the Oklahoma Administrative Code.

The Oklahoma Register and the documents accepted for publication are AVAILABLE FOR PUBLIC INSPECTION at the Office of Administrative Rules pursuant to the Oklahoma Open Records Act. Printed copies of the Register are available for public inspection at many County Clerks' offices in Oklahoma and the Jan Eric Cartwright Memorial Law Library at 200 NE 18th Street in the State Capitol Complex. Electronic copies of the Register are also available online at the Office of Administrative Rules' website at www.rules.ok.gov.

Notices of Rulemaking Intent
Prior to adoption and gubernatorial/legislative review of a proposed PERMANENT rulemaking action, an agency must publish a Notice of Rulemaking Intent in the Register. In addition, an agency may publish a Notice of Rulemaking Intent in the Register prior to adoption of a proposed EMERGENCY or PREEMPTIVE rulemaking action.
A Notice of Rulemaking Intent announces a comment period, or a comment period and public hearing, and provides other information about the intended rulemaking action as required by law, including where copies of proposed rules may be obtained.

CHAPTER 15.  OAC Airport Construction Program

SUMMARY:
The proposed permanent rules will define an airport sponsor matching share and update information regarding state level and sponsor level participation. The Commission's maximum amount for terminal building projects will be increased. The Commission's cost share level of participation on hangar construction projects will be increased and the not to exceed cap removed. Fuel system construction projects will be eligible for Commission funding and the state level of participation identified. The Commission may provide funds at a 100% level for funding directed to the Commission by the legislature for specifically identified site locations and infrastructure projects. Additional changes include an updated FAA Order number related to the National Priority Rating System and grammatical changes throughout.
These permanent rules are necessary due to increased construction costs and to give the Commission the authority to direct funds specifically identified by the legislature.

SUMMARY:
The proposed rule changes, if approved, will clarify the total number of appointments to the Board and how the appointments are made. The proposed rule change corrects the location of the Board office and simplifies the process of a request for rulemaking. The proposed rule also fixes several typographical errors. The proposed rule specifies that any request for a rule change will be responded to within thirty days of submission. Finally, the proposed rule adds a definition for "eyelash extensions" and a definition for an "Eyelash Extension Specialist."

SUMMARY:
The proposed rule changes, if approved, will transform emergency rules into permanent rules, regarding individuals who have pleaded guilty, nolo contere, or have been convicted of a crime, or who have a criminal charge currently pending that is substantially related to the practice of occupations regulated by the Cosmetology and Barbering Act and poses a reasonable threat to public safety, health or welfare. See OAC 175:10-1-3. The changes are needed to make the rule language consistent with statutory changes to 59 O.S., § 4000.1, that became effective on November 1, 2022. The proposed rule changes do add a $95 fee for applicants to obtain an initial determination; however, the fee is specifically authorized by law (59 O.S., § 4000.1(J)), and the Board will waive the fee once for low-income individuals.
The proposed rule changes also: 1) allow schools to use electronic versions of the rule book (OAC 175:10-3-30); 2) distinguish between services provided in a licensee's residence and those provided in a patron's residence, consistent with newly-enacted 59 O.S., § 199.18 (OAC 175:10-7-1); 3) define with particularity what kinds of services "puncture the skin," and therefore are outside the scope of practice of Cosmetologists and Facialists/Estheticians (OAC 175:10-7-29); and 4) revoke OAC 175:10-9-54, consistent with the newly-enacted exemption from licensing for services that are incidental to theatrical, radio, television or motion picture productions, modeling or photography, in 59 O.S., § 199.6(E)(5).
Finally, several of the amended rules and the new rule establish a new limited specialty license for Eyelash Extension Specialists, consistent with the Board's authority in 59 O.S., § 199.3(B)(5). See OAC 175:10-3-16; 175:10-3-47; 175:10-7-33; 175:10-7-33.1; 175:10-9-55; 175:10-11-2; and 175:10-13-1. Eyelash Extension Specialists will be required to undergo only three hundred and twenty (320) hours of training, as opposed to the one thousand five hundred (1,500) currently required of Cosmetologists or the six hundred (600) currently required of Estheticians/Facialists; currently, per OAC 175:10-9-55, only licensed Cosmetologists or Facialists/Estheticians may perform eyelash extensions. The amended rules and new rule establish curriculum and examination requirements; sanitation, disinfection and safety requirements; set a licensure fee; and allow the Board to grant reciprocity for licensed specialists from other states. This less restrictive licensing program is needed to help settle litigation that was recently instituted against the State of Oklahoma, in Davis v. State Board of Cosmetology and Barbering, CV-2022-1729 (Okla. Cty. Dist. Ct. Sept. 7, 2022).

The proposed revisions will remove member caps for Physicians, Advanced Practice Registered Nurses (APRN), and Physician Assistants (PA) participating in SoonerCare Choice Patient Centered Medical Home. Currently, policy only allows 2,500 members for each physician, 1,250 members for each APRN, and 1,250 members for each PA. The proposed revisions will remove the member caps, which will increase members' access to care. The aforementioned changes will align policy with the redesign of the PCMH model.

The proposed revisions update policy to reflect that adults, covered by Medicaid, can access services provided by licensed clinical psychologists who bill independently and are practicing within state scope of practice. SUMMARY:
The proposed rule revisions will add language to the clinical trials policy in section OAC 317:30-3-57.1 that states that the Oklahoma Health Care Authority will provide a coverage determination within 72 hours on whether the study is appropriate and meets the members' medical necessity needs. Additional revisions to the out-of-state services policy, at OAC 317:30-3-90, will add language to assure that clinical trials will be provided in accordance with all federal regulations and that OHCA's out-of-state policy does not apply to certain cases that involve clinical trials. Furthermore, language will be added to allow for the override of prior authorizations that are related to lodging and meals services when they are provided in accordance with an approved clinical trial. Finally, revisions will add language that allows for a SoonerCare member to travel up to one hundred miles (100) from the Oklahoma border to receive dental services.

Finally, revisions will clarify that any problem that is encountered in the EPSDT screening and does not require significant additional work will be included in the EPSDT visit and should not be billed separately.

The proposed revisions to the DDS policy will reflect amendments made to the Community Waiver, Homeward Bound Waiver, In-Home Supports for Children and Adults Waivers. These amendments were recently approved by CMS and made effective October 1, 2022. The proposed revisions to the Family Support services policy will update coverage limitations for individual family training from $5,500 to $6,500 and group family training from $5,500 to $6,500 and revoke outdated documentation requirements language. Other revisions will add new language to outline criteria for respite care providers and homemaker services providers. Additional revisions will also add new language to clarify the termination process of remote supports services as well as provide new criteria and explain the exceptions allowed when agency companion services are provided. Further revisions to the specialized foster care (SFC) section will add new language to outline new SFC standards and criteria. Other revisions will add optometry benefits, which will allow routine eye examination and purchase of corrective lenses. Additional revisions add language to support the increase of the public transportation limit from $5,000 to $25,000. Further revisions provide a new residential service option, Extensive Residential Supports (ERS) for members with the most extensive behavioral support needs. Finally, revisions will update and remove outdated language and definitions, remove obsolete references, revoke/combine sections to comply with Executive Order 2020-03, which requires state agencies to reduce unnecessary and outdated rules. Revisions will also correct formatting and grammatical errors, as well as align policy with current business practices.

Other revisions will add new language to outline criteria for respite care providers and homemaker services providers. Additional revisions will also add new language to clarify the termination process of remote supports services as well as provide new criteria and explain the exceptions allowed when agency companion services are provided. Further revisions to the specialized foster care (SFC) section will add new language to outline new SFC standards and criteria. Other revisions will add optometry benefits, which will allow routine eye examination and purchase of corrective lenses. Additional revisions add language to support the increase of the public transportation limit from $5,000 to $25,000. Further revisions provide a new residential service option, Extensive Residential Supports (ERS) for members with the most extensive behavioral support needs. Emergency Adoptions
"If an agency finds that a rule is necessary as an emergency measure, the rule may be promulgated" if the Governor approves the rules after determining "that the rule is necessary as an emergency measure to do any of the following:
a. protect the public health, safety or welfare,
b. comply with deadlines in amendments to an agency’s governing law or federal programs,
c. avoid violation of federal law or regulation or other state law,

FINDING OF EMERGENCY:
The rule amendment is necessary pursuant to 75 O.S., § 253(A)(1)(a) and (e) to protect the public health, safety, or welfare and avoid serious prejudice to the public interest by regulating the licensure of individuals with misdemeanor or felony convictions, consistent with recent legislative changes to 59 O.S., § 4000.1 became effective on November 1, 2022.
GIST/ANALYSIS:
The Oklahoma State Board of Cosmetology and Barbering ("Board") proposes the rule changes referenced above for individuals who have pleaded guilty, nolo contere, or have been convicted of a crime, or who have a criminal charge currently pending that is substantially related to the practice of massage therapy and poses a reasonable threat to public safety, health, or welfare. The changes are needed to make the rule language consistent with the statutory changes that became effective on November 1, 2022.

SUBCHAPTER 5.  Licensure of Massage Therapists
175:20-5-7.  Disqualifying criminal history and opportunity for initial determination
(a)    Pursuant to 59 O.S. § 4000.1, the Board of Cosmetology and Barbering shall adopt a list of crimes that could disqualify a person from being licensed as a massage therapist. The Board shall adopt the list at its first meeting of the fiscal year and may modify the list as needed to protect public health and safety.
(b)    The misdemeanors and felonies in the list could disqualify an individual because they substantially relate to the practice of massage therapy and pose a reasonable threat to public safety, health or welfare, as explained below.
(1)     Crimes involving fraud, theft, lying, falsification and/or deception. Licensees may have unfettered access to their clients' financial information and valuables, including credit cards, checks, cash and jewelry. They also may have access to personal health information, from clients who disclose relevant health conditions or medications before treatment, including, for example, on intake forms. Massage therapy often occurs in a room where there is no direct supervision of the licensee, and where the client is in a state of undress and physically separated from his or her valuables. As a result, crimes involving fraud, theft, lying, falsification and/or deception are highly relevant to an individual's ability to provide safe massage therapy services.
(2)     Crimes involving violence and/or threatening behavior, including sexual misconduct. Massage therapists frequently provide services to partially clothed or fully undressed clients, who are particularly vulnerable to exploitation. On the other hand, local news articles often report on police raids on massage establishments that involve prostitution or human trafficking. As a result, crimes involving violence and/or threatening behavior, including sexual misconduct, are highly relevant to an individual's ability to provide safe massage therapy services.
(bc)    A person who has pleaded guilty, nolo contendere or been convicted of a crime on the list, or who has a criminal charge currently pending, may at any time, including before obtaining any required education or applying to sit for any necessary examination, request an initial determination as to whether the person's criminal history would potentially disqualify the individual from licensure as a massage therapist in Oklahoma. The request shall be in writing and shall include either a copy of the person's criminal history record; or a statement describing each conviction or plea, including the date of conviction or plea, the court of jurisdiction, and the sentence imposed. The person may submit any additional information, including, but not limited to, information relevant to:the person's current circumstances, the length of time since the completion of any sentence, including probation, evidence of rehabilitation, and testimonials or personal reference statements, as well as the person's professional aspirations
(1)    The nature and seriousness of the offense;
(2)    The amount of time that has passed since the offense;
(3)    The age of the person at the time the offense was committed;
(4)    Circumstances of the offense, including aggravating or mitigating circumstances of social conditions surrounding the commission of the offense;
(5)    The nature of the specific duties and responsibilities for which the license is required; and
(6)    Rehabilitation, including, among other things, evidence related to the person's compliance with conditions of community supervision, parole or mandatory supervision; the conduct and work activity of the person; programming or treatment undertaken by the person; and testimonials or personal reference statements.
(cd)    Upon receipt of a written request for consideration of a person's criminal history record, the Executive Director, the Chair of the Board of Cosmetology and Barbering, and the Chair of the Advisory Board, in consultation with Board legal counsel, shall evaluate the request and make an initial determination based upon the information provided. A notice of initial determination shall be issued within sixty (60) days from the date the request was received. If the person is not satisfied with the response, the person may request that the matter be placed on the agenda of the Board's next regularly scheduled meetingset for hearing, consistent with the Board's rules of practice, in OAC 175:1-5.
(de)    The notice of initial determination shall be in writing and mailed to the requestor at the address provided in the request, and shall contain the following statements:
(1)    Whether the person appears is eligible for licensure at the current time based upon the information submitted by the requestor;
(2)    Whether there is a disqualifying offense prohibiting that would disqualify the person's licensureperson from engaging in massage therapy at any the current time and a statement identifying such offense in the criminal history record or information submitted for consideration;
(3)    Any actions the person may take to remedy what appears to be a temporary disqualification, if any;
(4)    The earliest date the person may submit another request for consideration, if any; and
(5)    A statement that the notice of initial determination is only an initial determination for eligibility for licensure based upon the information provided by the requestormay be rescinded if, at the time a full application for a license is submitted, the applicant has subsequently pled guilty or nolo contendere to a crime, has pending criminal charges or has previously undisclosed criminal convictions. Additional information or intervening events may result in a different final determination.
(ef)    A person who has pleaded guilty, nolo contendere or been convicted of a crime on the list adopted by the Board pursuant to this section, or who has a criminal charge currently pending, shallmay not be eligible for licensure for a period of three at least five (5) years from the date of the conviction, plea or convictionrelease from incarceration, whichever is later. Applicants whose pleas or convictions occurred more than three years prior to the date of application for licensure shall be evaluated on a case-by-case basis.
(g)    The Executive Director is authorized to close a file requesting initial determination of eligibility when the person seeking determination of eligibility for licensure has failed to respond to a written request from the Board for information, within forty-five (45) days of the written request.

Executive Orders

TITLE 1.  EXECUTIVE ORDERS

Executive Order 2023-1
One of a state's most important responsibilities is to protect the lives and safety of its citizens. Paramount among these, is protecting and enhancing the lives of our children. Some of the hardest and most difficult work that any state does is in child welfare. We must continue to meet this challenge head on. As Governor I am committed to protecting our youngest and future generations.
When Oklahoma first began implementing the Pinnacle Plan, our state's child welfare situation was a disaster. While the Pinnacle Plan has served to improve our child welfare system, we must seek continued and ongoing improvement in this area. Currently 6.89 out of every 1,000 Oklahoma children are in an out-of-home placement, which is slightly above the national average of 6 per 1,000. This is a 17 percent decrease since I took office on January 14, 2019. We need to decrease this to 4 per 1,000 children to achieve Top 10 status. Additionally, Oklahoma has made progress improving many of its permanency and re-entry programs, but we need to continue to make improvements ensuring that our state achieves timely and safe permanency for children in the child welfare system. Simply put, we have made great progress in the area of child welfare in Oklahoma, but our work here is not yet done.
Not only must we work to improve our child welfare system, but the best way to address these problems are to ensure children never end up in the system in the first place. The best environment for a child is having their two, biological parents living in the same household. I recently created a HELP Task Force to study and address at-risk pregnancies. But Oklahoma must continue to address problems that occur once children are born. Oklahoma's fathers must do their part as well. Paternal absence is the single greatest risk factor in teen pregnancy for girls. And young men who grew up with their biological father are more than twice as likely to graduate college and less likely to go to jail. To be clear, we cannot leave children in unsafe environments, whether with their biological family or not. But as a state we must do all that we can to provide proper resources to ensure that all our citizens can provide a safe, healthy, and happy home for their children. Our future depends upon it. Improving Oklahoma's child welfare system is not the only challenge; reducing the amount of children in the system is even more critical.
Therefore, I, J. Kevin Stitt, Governor of the State of Oklahoma, pursuant to the power and authority vested in me by Sections 1 and 2 of Article VI of the Oklahoma Constitution, and to the fullest extent permitted under Oklahoma law, hereby order the formation of a Child Welfare Task Force ("Task Force").
The Task Force shall study, evaluate, and make recommendations regarding policies, programs and proposed legislation that will:
   1. Further reduce the time to permanency in the foster care system;
   2. Further reduce the amount of re-entries to foster care after discharge to permanency;
   3. Identify risk factors that lead to the removal of children from their biological parents' home; and
   4. Identify and propose areas of support for biological parents.
The Task Force shall submit to the Governor, the President Pro Tempore of the Oklahoma Senate, and the Speaker of the Oklahoma House of Representatives, a report on or before October 1, 2023, detailing its findings and recommendations.
The Task Force shall be composed of twelve (12) members determined as follows:
   1. The Speaker of the House or his designee;
   2. The President Pro Tempore of the Senate or his designee; and
   3. 2 designees of the Director of the Oklahoma Department of Human Services.
The Governor shall appoint eight (8) members to be determined as follows:
   1. 2 members of the Oklahoma state court system;
   2. 1 representative from an organization involved in the foster care system;
   3. 1 representative from a non-profit or faith-based organization;
   4. 1 person with experience advocating for biological families; and
   5. 3 at-large members.
The Governor shall select, from the appointed members, a Chair of the Task Force who shall have the authority to create committees and name committee chairs to facilitate the work of the Task Force and shall have the authority to appoint Task Force members and non-members to serve on committees. The Task Force shall meet as often as deemed necessary by the Chair allowing for timely completion of its work. A majority of the members shall constitute a quorum for the purpose of conducting the business of the Task Force. Members, including those appointed to committees who are not members of the Task Force, shall serve without compensation.
The Oklahoma Department of Human Services shall provide staff and administrative support for the Task Force. All Executive departments, officers, agencies, and employees of the State shall cooperate with the Task Force, including providing any information, data, records, and reports as may be requested.
This Executive Order shall be distributed to the Secretary of State, the Secretary of Human Services, the President Pro Tempore of the Oklahoma Senate, and the Speaker of the Oklahoma House of Representatives.

NOTICE OF STATE CEILING AMOUNT FOR THE CALENDAR YEAR 2023

In accordance with Title 62 O.S, Section 695.25, the maximum total volume (also referred to as "Volume Cap" or "State Ceiling Amount") of Private Activity Bonds that may be issued pursuant to federal law by the State of Oklahoma during calendar year 2023 is $482,376,000. From the first business day of 2023 through September 1, 2023, the Volume Cap is subdivided into the following categories ("Pools") and amounts: (1) Qualified Small Issue Pool, $57,885,120; (2) Exempt Facility Pool, $12,059,400; (3) Beginning Agricultural Producer Pool, $4,823,760; (4) Student Loan Pool, $74,768,280; (5) Economic Development Pool, $57,885,120; (6) Oklahoma Housing Finance Agency Pool, $72,356,400; (7) State Issuer Pool, $19,295,040; (8) Metropolitan Area Housing Pool, $60,297,000; (9) Rural Area Housing Pool, $38,590,080; and (10) Local Issuer Single Family Pool, $84,415,800. From September 2, 2023, to 9:00 a.m. on December 20, 2023, any amount remaining to be allocated from these pools is combined and managed from the Consolidated Pool. On or after 9:00 a.m. on December 20, 2023, certain Private Activity Bond issuing authorities may apply to the Deputy Treasurer for Debt Management to carry forward a portion of any remaining State Ceiling Amount.
