A BILL TO BE ENTITLED
|

AN ACT
|
|
|
relating to wrongful death actions by siblings of a decedent. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 71.004(b), Civil Practice & Remedies |
|
|
Code, is amended to read as follows: |
|
|
(b) The surviving spouse, children, siblings, and parents |
|
|
of the deceased may bring the action or one or more of those |
|
|
individuals may bring the action for the benefit of all. |
|
|
SECTION 2. The change in law made by this Act applies to a |
|
|
cause of action filed on or after the effective date. An action |
|
|
filed before the effective date of this Act is governed by the law |
|
|
in effect on the date the action was filed, and the former law is |
|
|
continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
