A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the reporting of child abuse or neglect. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 261.103, Family Code, is amended by |
|
|
amending Subsection (a) and adding Subsections (a-1) and (d) to |
|
|
read as follows: |
|
|
(a) Except as otherwise provided by this section |
|
|
[Subsections (b) and (c)] and Section 261.405, a report shall be |
|
|
made to: |
|
|
(1) any local or state law enforcement agency; and |
|
|
(2) the department. |
|
|
(a-1) If the alleged abuse or neglect occurred in a facility |
|
|
operated, licensed, certified, or registered by a state agency, a |
|
|
report may be made to[; or |
|
|
[(3)] the state agency that operates, licenses, |
|
|
certifies, or registers the facility in which the alleged abuse or |
|
|
neglect occurred in addition to the entities listed under |
|
|
Subsection (a). |
|
|
(d) A report must be made to the Texas Education Agency in |
|
|
addition to the entities listed under Subsection (a) if the report |
|
|
is based on alleged or suspected abuse or neglect that occurred at a |
|
|
public school. |
|
|
SECTION 2. Section 261.103(c), Family Code, is repealed. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
