A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the transport of female patients to a mental health |
|
facility or residential care facility. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1(c), Article 46.04, Code of Criminal |
|
Procedure, is amended to read as follows: |
|
(c) A female patient must be accompanied by a female |
|
attendant unless: |
|
(1) the patient is transported by a male attendant who |
|
is wearing a body worn camera, as defined by Article 2B.0101, that |
|
is activated for the duration of the patient's transport; or |
|
(2) the vehicle in which the patient is transported is |
|
equipped with audio or video recording devices that actively record |
|
for the duration of the patient's transport. |
|
SECTION 2. Section 574.045(d), Health and Safety Code, is |
|
amended to read as follows: |
|
(d) A female patient must be accompanied by a female |
|
attendant unless: |
|
(1) the patient is accompanied by her father, husband, |
|
or adult brother or son; |
|
(2) the patient is transported by a male attendant who |
|
is wearing a body worn camera, as defined by Article 2B.0101, Code |
|
of Criminal Procedure, that is activated for the duration of the |
|
patient's transport; or |
|
(3) the vehicle in which the patient is transported is |
|
equipped with audio or video recording devices that actively record |
|
for the duration of the patient's transport. |
|
SECTION 3. This Act takes effect September 1, 2025. |
