| A Year-End Letter from Your Co-chairs |
This year was certainly an interesting one for health care insolvencies, and tremendous uncertainties remain as we move toward 2018. The health care sector took years to adjust to the Affordable Care Act and now that questions have been raised as to the continued viability of such legislation, it is hard to predict what will happen. Professionals in the health care insolvency industry should be prepared to adjust to this ever-changing environment on a moment’s notice.
The Health Care Committee co-sponsored well-received panels in 2016 and 2017 at both the Annual Spring Meeting and the Winter Leadership Conference. At the 2016 Winter Leadership Conference, in collaboration with the Real Estate Committee, the Health Care Committee presented Fuse, Sever and Heal: Issues Impacting Healthcare Facilities in Bankruptcy, with panelists Thomas R. Califano, DLA Piper New York; Patricia B. Jefferson, Miles & Stockbridge P.C. Baltimore; Shawn M. Riley, McDonald Hopkins LLC Cleveland; and Frank P. Terzo GrayRobinson, P.A. Fort Lauderdale, Florida.
At the 2017 Annual Spring Meeting, in collaboration with the Consumer Committee, the Health Care Committee presented Who Pays the Price for Health Care Insolvencies: the Consumer, the Vendors or the Public at Large, with panelists Louis E. Robichaux, IV, Deloitte Transactions & Business Analytics LLP; Dallas, TX; Thomas A. Waldrep, Jr., Womble Carlyle Sandridge & Rice, LLP; Winston-Salem, NC; Scott A. Zuber, Chiesa Shahinian & Giantomasi PC; West Orange, NJ; and Clifford A. Zucker, CohnReznick LLP; Edison, NJ.
The Healthcare Committee and the Unsecured Trade Creditors Committee also hosted a Webinar, titled Navigating Health Care Bankruptcies to Maximize Creditor Recoveries, which was presented in September 2017 with Jeffrey K. Garfinkle, Buchalter Nemer, PC; Warren J. Martin, Porzio, Bromberg and Newman PC; and Adam C. Rogoff, Kramer Levin Naftalis and Frankel, LLP.
One of the Health Care Committee’s initiatives for 2018 will be conducting regular Committee educational calls to keep everyone current on hot topics in health care insolvencies. A Business Creditor’s Guide to Distressed Vendors, Debt Collection and Bankruptcy provides an insider’s look into the options available to help screen a business’s customers, plan for worst-case scenarios, and, if the situation does arrive, efficiently handle the fallout.
