Elizabeth Gunn and Beth Stephens, Co-Chairs of the ABI Consumer Committee this year would first like to thank all the members for the support and participation in 2017. We have an active and lively committee with monthly conference calls to keep events rolling along, but we are only as great as our members and their contributions.  The committee is always looking for contributors to the newsletter, suggestions for webinar or seminar topics, and individuals looking to get more involved.  If you are interested in contributing to the committee, please reach out to any leaders. 

The Consumer Committee has a number of sub-committees that are vital to the success of the committee throughout the year. Information about our sub-committees and emails of our committee leadership are listed below.

Jon Lieberman serves as our Membership Relations Director. During the past year, in an effort to promote membership in and the work of the Consumer Bankruptcy Committee, Jon Lieberman has continued his efforts contact with numerous Seminar Chairs and Advisory Boards of the many ABI seminars.  In addition, Jon takes the time to personally send a welcome to new committee members.  Jon is hard at work on a consumer reception for this spring’s Annual Spring Meeting, so keep your eye out for details.

Richard Cole serves as our Education Director. For the 2017 Winter Leadership Conference the consumer committee partnered with the young and new members committee to form a panel which examined the challenging and ever-changing issues in individual chapter 11 cases.

At the 2017 Annual Spring Meeting, Richard organized a unique presentation with the labor & employment committee covering the practical issues faced by employers and consumers in bankruptcy, such as use of corporate credit cards, reimbursement of business expenses, and security clearance.

Cecilia Lee is our Newsletter Editor. The Consumer Newsletter has articles on a variety of topics, Including vesting of property, CFPB developments, and recent circuit decisions of note.If you missed an edition, please let us know. The great news is, we are always accepting original articles for the committee newsletter. If you are interested in writing an article on a particular issue you find to be of regional or national interest, please reach out to Cecilia.

David Cox, our Communications Manager, heads up our Listserve, which is always active. While David periodically posts cases or issues of interest, we encourage everyone to make use of the Listserve. The Listserve is also an excellent source for referrals when you need out of state counsel.

In addition to their work on the Collier Consumer Bankruptcy Case Update you receive weekly via e-mail (more information below), our Special Projects Leaders, Deborah Langehennig and William Amann, have hosted two webinars this year — one on new CFPB regulations, and the other on the upcoming December 1, 2017 amendments to the federal rules and the proposed national form plan. Both webinars were a great success. In the meantime, Deborah and William are preparing additional webinars for next year, including one covering the initial practical impacts of the December 1, 2017 rule changes, a follow up to their January 2017 webinar covering the scope of the modifications.

We always need new members. So how do you get involved? To join, simply go to the ABI website Committees tab toward the bottom of your profile page. Then click the edit button to select from the list of committees and save your choices. Jon Lieberman, our Membership Relations Director, will be in touch.

 
 
 
 
 

Is there a way you can quickly peruse the Bankruptcy Code, Rules and local rules? Indeed, there is: ABI’s new and improved law.abi.org site!  ABI's Law site has always been the most reliable, up-to-date online Code and Rules, but now it has a new look and brand new features.

As before, ABI members can access, annotate and bookmark the Code and Rules from any device, and Law contains all of the new amendments effective December 1.  The newly designed site now also allows members to:

  • view local rules for all 50 states and territories (new!);
  • read corresponding pertinent Collier case updates (from LexisNexis), Rochelle’s Daily Wire analyses and cross-references from ABI’s Volo site (new!); and,
  • cut and paste sections easily into documents and e-mails (new!).

ABI is pleased to announce the inaugural class of its “40 Under40” initiative. The honorees were recognized at a special luncheon during ABI’s 2017 Winter Leadership Conference. Candidates were chosen from both large and small firms from every region of the country, and represent diverse practice areas such as law, finance, consulting, academia, government and more.

ABI Consumer Commission Opens for Comments and Hearings in 2017

The ABI Commission on Consumer Bankruptcy is charged with researching and recommending improvements to the consumer bankruptcy system that can be implemented within its existing structure. These changes might include amendments to the Bankruptcy Code, changes to the Federal Rules of Bankruptcy Procedure, administrative rules or actions, recommendations on proper interpretations of existing law and other best practices that judges, trustees and lawyers can implement. During 2017, six public hearings were held across the country and were open to all individuals interested in contributing to the study.
