| A Year-End Letter from Your Co-chairs |
It’s been another great year for the Commercial Fraud Committee, producing four newsletters, several new case updates, a webinar program regarding bankruptcy fraud, and a networking event and a committee-wide call for our members. Here are a few highlights of the Committee’s activities in 2017, as well as several ways for you to get more involved in 2018:
Committee Panel at the 2017 Annual Spring Meeting
The Commercial Fraud Committee paired with the Secured Credit Committee at the 2017 Annual Spring Meeting to present a program entitled “The Rights of Secured Creditors in a Commercial Fraud Case.” The panelists included Robert M. Charles, Jr. (Lewis Roca; Tucson), Richard J. Corbi (Otterbourg; New York), James A. Lodoen (Lindquist & Vennum; Minneapolis), with Randye B. Soref (Posinelli; Los Angeles) serving as moderator. In addition, the Commercial Fraud Committee won the “Committee of the Year” award at the 2017 Annual Spring Meeting.
Committee Panel at the 2017 Winter Leadership Conference
The Commercial Fraud Committee paired with the Bankruptcy Litigation Committee at the 2017 Winter Leadership Conference to present a program entitled “Developments Concerning the Extraterritorial Limits on Clawback Actions.” The panelists included Stacy A. Dasaro (BakerHostetler; New York), Gregory S. Grossman (Sequor Law; Miami), Vincent E. Lazar (Jenner & Block; Chicago), and Eric (Rick) S. Rein (Horwood Marcus & Berk; Chicago).
Committee Webinar Regarding Bankruptcy Fraud
The Commercial Fraud Committee produced a well-attended webinar entitled “All About Bankruptcy Fraud with a Dose of Reality . . . TV.” The panelists included Erin Schmidt (U.S. Trustee’s Office; Dallas) and Matthias Kleinsasser (Forshey & Prostok; Fort Worth), with Eric D. Madden (Reid Collins, Dallas) serving as moderator. The panel presented an entertaining discussion about how certain reality television stars and other celebrities have become entangled in allegations of bankruptcy fraud.
Committee Networking Events
The Commercial Fraud Committee hosted a networking event at the annual conference for the National Association of Federal Equity Receivers, which was held in October 2017. As part of this networking event, the Committee presented a program entitled “ESI and Discovery Issues in Commercial Fraud Cases.” The panelists included Drew M. Dillworth (Stearns Weaver; Miami), David L. Gay (Berger Singerman; Miami), and John Jorgensen (Sylint Group; Sarasota), with Kathy Bazoian Phelps (Diamond McCarthy; Los Angeles) serving as moderator.
The Commercial Fraud Committee also continued its practice of hosting committee-wide calls for our members around the country. For example, in June 2017, the Committee hosted a conference call to update our members on committee activities and to present a program regarding the Fifth Circuit’s important decision in Janvey v. Golf Channel, Inc. This program was presented by Kevin Sadler (Baker Botts; San Francisco), who represented the receiver in the underlying case.
Committee Newsletters and New Case Updates
The Commercial Fraud Committee provided written analysis and commentary to our members throughout 2017. For example, the Committee published four newsletters in 2017, which included more than a dozen articles. The Committee also published updates regarding several important new cases on our listserve.
Ways for You to Get Involved
The Committee is only as good as its members and their contributions. To that end, we encourage you to get more involved in the Committee during 2018. There are several ways to do so, including:
- Write a short article for our newsletter;
- Speak about a particular topic on a webinar or a committee-wide call; and
- Post updates regarding new cases and other issues to our listserve.

Is there a way you can quickly peruse the Bankruptcy Code, Rules and local rules? Indeed, there is: ABI’s new and improved law.abi.org site! ABI's Law site has always been the most reliable, up-to-date online Code and Rules, but now it has a new look and brand new features.
As before, ABI members can access, annotate and bookmark the Code and Rules from any device, and Law contains all of the new amendments effective December 1. The newly designed site now also allows members to:
- view local rules for all 50 states and territories (new!);
- read corresponding pertinent Collier case updates (from LexisNexis), Rochelle’s Daily Wire analyses and cross-references from ABI’s Volo site (new!); and,
- cut and paste sections easily into documents and e-mails (new!).
