End-User License Agreement of Wangsu Host Intrusion Detection System
Before you use the host intrusion detection system (hereinafter referred to as "HIDS") provided by Wangsu Science & Technology Co., Ltd. (hereinafter referred to as " Wangsu " and "We"), please read the End-User License Agreement for Wangsu Host Intrusion Detection System (hereinafter referred to as "Agreement") carefully.If you do not agree with all the terms of this agreement, please do not install or use the HIDS.Once you install or use the HIDS, that means you agree to accept all terms of agreement.
1? Product Description
The HIDS is the way to access Wangsu host intrusion detection system platform.
Wangsu host intrusion detection system continuously monitors and analyzes host assets and process behaviors through lightweight host probes deployed on the host, combined with cloud intelligent analysis engine and threat intelligence. It aims at common risk threats such as weak passwords and high-risk vulnerabilities, as well as hacker intrusion behaviors such as website backdoor implantation, virus trojan operation, and sensitive file tampering. It provides the ability to discover risks in advance, detect intrusions in the event, and trace sources after the event to ensure host security and protect enterprise digital assets.
You can quickly access host intrusion detection system platform by deploying HIDS on the AWS virtual machine, so as to provide AWS virtual machine with comprehensive risk management and intrusion detection capabilities and ensure the security of your host assets.
2? Permission Granted
According to terms and conditions of the agreement, Wangsu hereby grants you a paid, non-exclusive, non-transferable, copying, and modifying license to use the HIDS. You can search in AWS application market and choose to install HIDS on the recommended instance type (such as c5. xlarge).
When you purchase HIDS service, you must submit order demand and confirm order information according to relevant procedures and rules published on website. After order is submitted, the submitted information cannot be modified.
After submitting order and completing payment, you need to contact operation and maintenance person of Wangsu to obtain serial number (SN) of HIDS and complete authentication.
In addition to above permission, Wangsu expressly reserves all other rights contained in HIDS. Unless otherwise agreed in writing by Wangsu, you cannot:
1. Modify HIDS or create its derivative version;
2. Distribute, publish, display, sub-license, give, or transfer HIDS;
3. Decoding, reverse engineering, dismantling, or deleting HIDS;
4. Modify or delete any hint or mark about copyright, trademark or patent in HIDS;
3? License Termination
The agreement shall continue to be valid until termination proposed by Wangsu in writing.If you violate any terms of agreement, your right to use HIDS will automatically terminate without further written notice from Wangsu.When agreement terminates, you must stop using HIDS and destroy all HIDS owned or controlled by you, otherwise you will bear all legal liabilities.
4? Disclaimer
5. The HIDS does not contain any express, implied or any other form of warranty when it is provided, and you must bear risk of using HIDS.
6. In any case, we are not responsible to you or any third party for any loss (including but not limited to loss of business profits, business interruption or loss of business information) caused by the use or inability to use HIDS, even though we have been informed that such loss may be caused under no circumstances will Wangsu bear any liability for any direct, indirect, incidental, consequential, special and punitive damages, whether the claim is based on warranty, contract, tort (including negligence) or other reasons.
7. If obligations under agreement are delayed or not performed due to any reason beyond our reasonable control (including natural disasters, labor disputes or other industrial disturbances, electrical or other power failures, public utilities or telecommunications failures, earthquakes, storms or other natural factors, blockades, embargoes, riots, government acts or orders, terrorist acts or wars), we are not responsible.
8. You can only use HIDS service within scope permitted by the laws (including laws and regulations) of People's Republic of China and agreement. If you do not comply with corresponding terms or policies, we can suspend or stop providing services to you.
5? Legal Liability
9. You agree that any risk arising from use of HIDS shall be borne by you.
10. You agree that all losses and legal liabilities arising from illegal use of HIDS will be borne by you, which has nothing to do with Wangsu.
11. You agree that you will bear all losses caused to Wangsu due to your improper use of HIDS.
6? Intellectual Property
The intellectual property rights of HIDS belong to Wangsu independently. Except for rights and licenses expressly granted in agreement, you will not obtain ownership or license of any copyright, trademark right, patent right, trade secret or any other intellectual property rights due to agreement. All information related to HIDS is trade secrets and confidential information of Wangsu, which are protected by relevant laws and regulations of People's Republic of China.
7? Not Used for Illegal or Prohibited Purposes
When you use HIDS, you shall not use HIDS for any illegal purposes or purposes prohibited by terms of agreement.
8? Retention of Rights and Ownership
The HIDS reserves all rights not expressly granted to you in agreement. HIDS reserves right to update agreement at any time, and only needs to publish it on website of Wangsu, without your prior consent and without further notice. The updated content should take effect immediately after publication. You can check the latest version of user license agreement at any time by visiting website of Wangsu. If you continue to use HIDS after update takes effect, it will be deemed that you have accepted new terms.
9? Version Upgrade
Whether HIDS will provide version upgrade service in the future will be decided by Wangsu.
If Wangsu agrees to upgrade version, agreement will still apply after upgrade unless there is a substitute user license agreement after upgrade.
10? Governing Law and Dispute Resolution
The agreement is governed by the laws of People's Republic of China. In case of any dispute arising from the signing, performance or interpretation of agreement, both parties shall try to settle it through friendly negotiation. If negotiation fails, both parties agree to submit dispute to China International Economic and Trade Arbitration Commission for arbitration in accordance with its effective arbitration rules when submitting.
