Food Safety and Standards Authority of India monitors the production, storage and distribution of food in keeping with certain food safety standards in order to ensure that they are healthy and fit for human consumption. The Association of Food and Drug Officials (AFDO) was established in 1896 to foster uniformity in the adoption and enforcement of safety laws, rules and regulations as they apply to science-based foods, drugs, medical devices and cosmetics. The Association of Public Health Laboratories (APHL) is the national nonprofit representing governmental laboratories that monitor and detect public health threats, ranging from lead contamination in drinking water to metabolic and genetic conditions in newborns.  Laboratories in public health serve as laboratory first responders, protecting the public from diseases and environmental health hazards.
The International Association for Food Protection (IAFP) was founded to provide information and expertise surrounding the latest food safety challenges and solutions to scientists, researchers, and specialists from around the world.  The organization publishes two food safety journals providing scientific articles and information, Journal of Food Protection and Food Protection Trends.
The National Environmental Health Association (NEHA) was created to establish a standard of excellence for environmental health specialists and sanitarians. According to an analysis by the Partnership for Food Safety Education (PFSE), academia, public health agencies and schools are the most active sources of food safety education in the U.S.
PFSE commissioned North Carolina State University to conduct the survey to identify the organizations most involved with food safety education, the audiences they serve, and the channels they use most frequently to communicate safe food handling messages. The organization released the results of its “environmental scan” at the 2014 Consumer Food Safety Education Conference on Thursday, Dec. The survey found that academia (including cooperative extension) is the biggest source for consumer educators, followed by public health services, Family and Consumer Sciences teachers and people involved with school food service, the federal government, and non-profit organizations.
The next most popular channel was the web, which is used by 36 percent of educators — mostly in the federal government. While cooperative extension represents the majority of educators who come in contact with consumers, the survey found that the government reaches the most people on an annual basis (through programs such as Food Safe Families, Cook it Safe and Fight BAC!).


Across the three most active groups, children and families with children are the primary targets for education — important since half of all foodborne illness hospitalizations are children.
One disappointing finding was that half of educators reported that they were not monitoring their organizations’ impact or don’t know whether they are. FSMA permits some use of interim final rules, but does not expressly except those rules from the requirements of the Administrative Procedure Act (APA) and the rule of construction requiring such express exception. The existence of some permissive interim final rule authorities excludes the interim final rule from use where Congress has not permitted its use. Even the suggestion of use of interim final rule is permissive, vesting the Secretary and FDA with discretion, not a ministerial duty.
The “deadlines” have no express consequences and the courts have required more than generalized requisitions amid the plethora of conflicting requirements lack of appropriations sufficient to fulfill them all.
The complaint at least correctly recites that Executive Order 12866 provides for the centralized review of regulations by OMB to ensure that regulations are consistent with applicable law and the President’s priorities, and that decisions made by one agency do not conflict with policies and actions taken or planned by another agency (and all things are waivable). At bottom, the complaint asks the court to substitute its judgment for that of the Administration, and ignores binding precedent in the Ninth Circuit. In general, courts are reluctant to find unreasonable agency delay because they are hesitant to question agency priority setting and allocation of scarce resources.  Where successful, lawsuits alleging unreasonable delay by FDA generally have involved delays much longer than the present alleged delay in FSMA implementation.


The complaint may serve some political purpose in bringing a small amount of political pressure to bear on the Administration, but, as a question of administrative law, it is ill-advised and premature.  The better course is methodical analysis, not a rush to judgment.
