Checks and balances is a system that prevents each of the branches from having too much power.
Students will analyze the three branches of government and understand the system of checks and balances. The Founding Fathers, the framers of the Constitution, wanted to form a government that did not allow one person to have too much authority or control. With this in mind the framers wrote the Constitution to provide for a separation of powers, or three separate branches of government. Aedile - An Aedile was a city official who was responsible for the maintenance of public buildings as well as public festivals. It is called the separation of powers in which government is divided into the three following branches: legislative, executive, and judicial.
For example, when a law is made, it starts with the Legislative branch that introduces and votes on a bill. What fraction of Congress must agree to propose (suggest) an amendment (a change to the Constitution)? Each has its own responsibilities and at the same time they work together to make the country run smoothly and to assure that the rights of citizens are not ignored or disallowed.

Elected officials were called magistrates and there were different levels and titles of magistrates. This was how the common people, plebeians, could elect their own leaders, magistrates, pass laws, and hold court.
Many politicians who wanted to be elected to a higher office, like consul, would become aedile so they could hold big public festivals and gain popularity with the people. They also had some responsibilities to maintain public morality and to look after public finances.
The constitution was more of a set of guidelines and principals that were passed down from generation to generation. This separation act alone helps prevent tyranny and lets each branch have their own job, unlike our government in which everything is controlled solely by the King. Yet government under the Articles of Confederation taught them that there was a need for a strong centralized government. It was a complex government with a constitution, detailed laws, and elected officials such as senators. In order to keep the consul from becoming a king or dictator, there were always two consuls elected and they only served for one year.
The governor would be in charge of the local Roman army and would also be responsible to collect taxes.

As seen above, the executive branch has the powers to appoint judges and pardon power for the judicial branch as well as veto bills or laws for the legislative branch. A branch may use its powers to check the powers of the other two in order to maintain a balance of power among the three branches of government.
Many of the ideas and structures of this government became the basis for modern democracies. This may sound unfair, but it was a big change from other civilizations where the average person had no say at all. In Rome, the regular people could band together and have considerable power through the Assembly and their Tribunes. The Judicial branch can over rule the president's "yes" by declaring something unconstitutional.
