The court, which was hearing the issue related to the derecognition of some colleges offering B.Ed course in Madhya Pradesh, asked the Member Secretary, NCTE, to file an affidavit regarding the compliance of the Act of NCTE and the regulation framed subsequently.
The court also directed the counsel for Madhya Pradesh to place before it entire list of private and affiliated colleges of seven universities in the state offering the B.Ed course from the academic session 2005-06 to 2008-09. It said that in this regard, the counsel will have to consult the Secretary, Higher Education of the State, who in turn will get in touch with the Vice Chancellors of the universities. Further, the counsel for Barkatullah University, Bhopal, will also furnish the list of colleges affiliated to it for offering the B.Ed course. The bench said the counsel for colleges will file written submissions and make available documents relating to affiliation within three days.
The apex court was anguished that some colleges were allegedly offering B.Ed courses in Madhya Pradesh in breach of the NCTE Act. The bench was hearing the appeals filed by the colleges and students against the decision of the Madhya Pradesh High Court cancelling the recognition of some of the colleges. The colleges are seeking directions to seven universities in the state to declare the results of students who were provisionally admitted by them during the academic year 2007-08. Education, Haryana, have been recognized in the State of Haryana for admission and recruitment purposes. Counsel for the petitioners have also argued that their applications have been rejected vide Annexure P-9 on the ground that ETT Diploma from JandK State Board of School Education is not recognized by the NCTE whereas according to the learned counsel this Act is not applicable to the State of JandK. Counsel for the petitioners have also contended that the curriculum of the two years Diploma in ETT from JandK State Board of School Education is absolutely the same as the curriculum of ETT Course conducted in the State of Haryana. It has been averred in the written statement that vide Annexure P-9 it has been decided not to recognize the two year Diploma in ETT from JandK State Board of School Education as equivalent to two year D.Ed.
It is further the case of the respondents that the JandK State Board of School Education is not available on the website and, hence, the Diploma acquired by the petitioners from the JandK State Board of School Education cannot be held to be equivalent to two years D.Ed. Apart from the above, the JandK State Board of School Education have clearly indicated in their letter-Annexure P2 that the examinations set by their Board are recognized by all the School Boards and Secondary School Boards in the country including Haryana Board of School Education etc.
Elementary Teachers Training acquired by the petitioners from the JandK State Board of School Education is valid and shall be recognized in the State of Haryana for the purposes of admission as well as recruitment. Some of the petitioners in these bunch of writ petitions are working as Guest Faculty Teachers and as their services were sought to be terminated, they obtained stay from this Court that their services be not terminated on the ground that they had passed the diploma from JandK State Board of School Education. The petitioners pray that their services be not terminated now in view of order-Annexure P-9 having been quashed and as they have been found eligible for the said post. The petitioner Society has approached this Court for the issuance of directions to the respondent University to consider and grant affiliation to the College run by the petitioner Society for B.Ed course for the session 2006-07. Society, on the basis of a recognition granted by National Council for Teacher Education on August 27, 2006 (Annexure P.3).
Shri Aman Chaudhary, the learned counsel appearing for the petitioner Society has informed the Court that vide a subsequent communication dated September 29,2006, NCTE had granted conditional permission to the College to conduct B.Ed course of one year duration with effect from the session 2006-07 with an annual intake capacity of 100 students subject to appointment of staff as per regulations and ratification by the University. As a matter of fact, Shri Gupta has very fairly conceded that in view of ratification (Annexure P.12) by the University with regard to the teaching faculty recruited by the petitioner Society, the petitioner Society is duly eligible for the grant of provisional affiliation and the University shall have no objection if the College is directed to be granted a provisional affiliation because of the recognition granted by NCTE. The question of law is whether these institutions have a right to affiliation after grant of recognition by the National Council for Teacher Education.

It has also been averred that the ETT Course is broadly based on the curriculum framework proposed by the NCTE. The respondents have not denied the averments made in the writ petition regarding the assertion made by the petitioners in this respect in their written statement.
As all the petitioners had been allowed to be provisionally interviewed, therefore, now their results shall be declared. The petitioner Society has averred that NCTE had granted the aforesaid conditional recognition to the petitioner Society subject to appointment of staff by a duly constituted Selection Committee with the requisite qualification as per norms and standards of NCTE and affiliating University. Shri Chaudhary has also drawn our pointed attention to the constitution of Selection Committee (Annexure P.13) and has contended that the aforesaid Selection Committee comprised of representatives of Kurukshetra University also.
The factum of granting recognition by NCTE to the petitioner Society is even conceded by Shri Vinod S. Nos.17964 of 2005 18620 of 2005 18659 of 2005 18805 of 2005 19517 of 2005 18918 of 2005 2977 of 2007 2697 of 2007 and 20696 of 2006 as the common question of law arises in all of them. But the fact that 130 of these could not get recognition, the seats are reduced to almost half.The NCTE finalised the list of colleges that have been recognised for the session on Wednesday.
