The Department of Basic Education says they have delivered textbooks to all Limpopo schools. Meanwhile, Human Rights Organisation Section 27 says they have also heard from some Limpopo schools that they are still awaiting the delivery of textbooks; however they have not heard any negative report about other provinces.

This comes after 27 schools were identified for closure on the grounds of underperformance by the WCED. According to EE, while school closures may be legitimate and necessary in some cases, these closures should not be viewed as a reformative mechanism.


EE argues that underperformance is an insufficient and impermissible reason for school closure. The South African Schools Act stipulates that "the Head of Department must take all reasonable steps to assist a school in addressing the underperformance". EE's chairperson, Ntuthuzo Ndzomo says, "The WCED's High School Support Programme is targeted specifically at content subjects but neglects literacy which is essential to learner performance.
EE lashed out that the WCED must not evade its obligations to provide substantive support, and instead turn to the "quick fix" alternative of closure. Department Spokesperson Panyaza Lesufi says Limpopo learners will not go through the same thing this year as experienced in 2012. The Board is composed of the following eleven members: the superintendent of public instruction, the president of a state university or state college, four lay members, a president or chancellor of a community college district, a person who is an owner or administrator of a charter school, a superintendent of a high school district, a classroom teacher and a county school superintendent. Department of Education’s website are a set of materials that provide a substantive overview of the Elementary and Secondary Education Act (ESEA) flexibility process—also known as ESEA waivers—by which 34 states and the District of Columbia have applied for and received flexibility regarding certain provisions of ESEA. EE says in the on-going Cape Town schools saga it is clear there have been no comprehensive, sustained and targeted interventions implemented by the WCED to improve learner performance at these schools.
The WCED must keep the three 'underperforming' schools open and ensure that substantive, sustained interventions are made to improve learner performance at these schools. Schools must be kept open where relocation to placement schools will infringe children's right to education - whether because of language, subject, capacity or safety reasons.


A comprehensive and detailed transport plan for rural schools  must be produced immediately. The WCED must commit to finishing the process of future school closures earlier in the year, well before school enrolment deadlines. Last year learners in four grades did not have textbooks resulting in an outcry countrywide.

The intent of these materials—a brochure and five companion fact sheets—is to explain the rationale and intent of ESEA flexibility, as well as address its key components and highlight plan elements for a number of states approved for flexibility.
