The National Council for Teacher Education, in its previous status since 1973, was an advisory body for the Central and State Governments on all matters pertaining to teacher education, with its Secretariat in the Department of Teacher Education of the National Council of Educational Research and Training (NCERT). The main objective of the NCTE is to achieve planned and coordinated development of the teacher education system throughout the country, the regulation and proper maintenance of Norms and Standards in the teacher education system and for matters connected therewith.
NCTE has its headquarder at New Delhi and four Regional Committees at Banglore, Bhopal, Bhubaneshwar and Jaipur to look after its statutory responsibilities. The court, which was hearing the issue related to the derecognition of some colleges offering B.Ed course in Madhya Pradesh, asked the Member Secretary, NCTE, to file an affidavit regarding the compliance of the Act of NCTE and the regulation framed subsequently.
The court also directed the counsel for Madhya Pradesh to place before it entire list of private and affiliated colleges of seven universities in the state offering the B.Ed course from the academic session 2005-06 to 2008-09. It said that in this regard, the counsel will have to consult the Secretary, Higher Education of the State, who in turn will get in touch with the Vice Chancellors of the universities. Further, the counsel for Barkatullah University, Bhopal, will also furnish the list of colleges affiliated to it for offering the B.Ed course. The bench said the counsel for colleges will file written submissions and make available documents relating to affiliation within three days.
The apex court was anguished that some colleges were allegedly offering B.Ed courses in Madhya Pradesh in breach of the NCTE Act.
The bench was hearing the appeals filed by the colleges and students against the decision of the Madhya Pradesh High Court cancelling the recognition of some of the colleges. The colleges are seeking directions to seven universities in the state to declare the results of students who were provisionally admitted by them during the academic year 2007-08. Education, Haryana, have been recognized in the State of Haryana for admission and recruitment purposes. Counsel for the petitioners have also argued that their applications have been rejected vide Annexure P-9 on the ground that ETT Diploma from JandK State Board of School Education is not recognized by the NCTE whereas according to the learned counsel this Act is not applicable to the State of JandK.
Counsel for the petitioners have also contended that the curriculum of the two years Diploma in ETT from JandK State Board of School Education is absolutely the same as the curriculum of ETT Course conducted in the State of Haryana. It has been averred in the written statement that vide Annexure P-9 it has been decided not to recognize the two year Diploma in ETT from JandK State Board of School Education as equivalent to two year D.Ed. It is further the case of the respondents that the JandK State Board of School Education is not available on the website and, hence, the Diploma acquired by the petitioners from the JandK State Board of School Education cannot be held to be equivalent to two years D.Ed.
Apart from the above, the JandK State Board of School Education have clearly indicated in their letter-Annexure P2 that the examinations set by their Board are recognized by all the School Boards and Secondary School Boards in the country including Haryana Board of School Education etc. Elementary Teachers Training acquired by the petitioners from the JandK State Board of School Education is valid and shall be recognized in the State of Haryana for the purposes of admission as well as recruitment.
Some of the petitioners in these bunch of writ petitions are working as Guest Faculty Teachers and as their services were sought to be terminated, they obtained stay from this Court that their services be not terminated on the ground that they had passed the diploma from JandK State Board of School Education. The petitioners pray that their services be not terminated now in view of order-Annexure P-9 having been quashed and as they have been found eligible for the said post. The petitioner Society has approached this Court for the issuance of directions to the respondent University to consider and grant affiliation to the College run by the petitioner Society for B.Ed course for the session 2006-07. Society, on the basis of a recognition granted by National Council for Teacher Education on August 27, 2006 (Annexure P.3).
Shri Aman Chaudhary, the learned counsel appearing for the petitioner Society has informed the Court that vide a subsequent communication dated September 29,2006, NCTE had granted conditional permission to the College to conduct B.Ed course of one year duration with effect from the session 2006-07 with an annual intake capacity of 100 students subject to appointment of staff as per regulations and ratification by the University. As a matter of fact, Shri Gupta has very fairly conceded that in view of ratification (Annexure P.12) by the University with regard to the teaching faculty recruited by the petitioner Society, the petitioner Society is duly eligible for the grant of provisional affiliation and the University shall have no objection if the College is directed to be granted a provisional affiliation because of the recognition granted by NCTE. The question of law is whether these institutions have a right to affiliation after grant of recognition by the National Council for Teacher Education.
The rejection means that the university will not be able to open distant education centres across Madhya Pradesh. The students union also threatened to intensify their stir if the management failed to take back their decision. In an application submitted to the chancellor under RTI, Thakur pointed out that it is obligatory for the chancellor under section 9 (2) of the Bihar State Universities Act, 1976 to inquire or cause inquiry to be made by any agency in his discretion on a public petition as the law presumes that wilful protection of corruption despite substantive material on record manifestly constitutes cognizable offence for the public servant. Earlier, citing instances of corruption, he had pointed out that MU vice-chancellor has appointed 21 college principals in blatant violation of the provision of the Bihar State Universities Act without the approval of the requisite number of members of the Selection Committee. MU officiating VC Arun Kumar said the auditorium, having a sitting capacity of 560, would facilitate holding of national seminars, conferences and meetings. In his petition, Sinha had challenged the appointment of these principals on the ground that that they were appointed in violation of the established norms. Singh said the court was also informed that no panel had been prepared for the appointments. The HC on Thursday also directed the state government and the MU authorities to state as to what happened to the inquiry conducted by the I C Kumar Committee into the matter. Incidentally, the varsity had earlier claimed that nothing was found amiss during the inquiry.
It may be mentioned here that a former member of the committee, Shiv Jatan Thakur, had charged MU officiating VC Arun Kumar with appointing inferior candidates as MU principals. Several senior teachers engaged in the evaluation work feel most of the co-examiners appointed this time are either not the subject teachers or not familiar with their subjects. Justifying the need to select experienced teachers for evaluation work, a senior English teacher said, I wanted to bang my head against the wall when my co-examiner awarded full marks for a wrong answer. A few co-examiners, who belong to affiliated colleges, said that they earn money from evaluation works. According to BSEB chairman Rajmani Prasad, a panel of senior teachers from different constituent colleges had prepared the list of head examiners and co-examiners this time. Prasad said that he himself had been visiting evaluation centres to check evaluation work across the state. The decision to this effect was taken in the academic council meeting of Patna University on Thursday. In this regard Dr Shambu Nath Singh, VC, Patna University said that it was decided in the meeting that an expert committee would take interview of 2003 batch of college teachers to decide their promotion. National Council for Teacher Education NCTE is situated in New Delhi of Delhi state (Province) in India.
Despite its commendable work in the academic fields, it could not perform essential regulatory functions, to ensure maintenance of standards in teacher education and preventing proliferation of substandard teacher education institutions. The mandate given to the NCTE is very broad and covers the whole gamut of teacher education programmes including research and training of persons for equipping them to teach at pre-primary, primary, secondary and senior secondary stages in schools, and non-formal education, part-time education, adult education and distance (correspondence) education courses.
In order to enable the NCTE to perform the assigned functions including planned and co-ordinated development and initiating innovations in teacher education, the NCTE in Delhi as well as its four Reginal Committees have administrative and academic wings to deal respectively with finance, establishment and legal matters and with research, policy planning, monitoring, curriculum, innovations, co-ordination, library and documentation, inservice programmes. Karnal, Board of School Education, Haryana, Bhiwani, State Board of Technical Education, Haryana would stand recognized in the State of Haryana for admission and recruitment purposes. It has also been provided that those degrees and diplomas which are recognized by the Government of India are deemed to be recognized by the Government of Haryana also. Thus, on both these counts the two year Diploma in ETT from JandK State Board of School Education acquired by the petitioners has to be considered to be valid for the purposes of employment. Thus, the rejection of the applications of the petitioners on the ground that it is not recognized by NCTE is wholly against the provisions of the Act itself which is not applicable to the State of JandK and also shows non-application of mind by the respondents.
It has also been averred that the ETT Course is broadly based on the curriculum framework proposed by the NCTE.
The respondents have not denied the averments made in the writ petition regarding the assertion made by the petitioners in this respect in their written statement. As all the petitioners had been allowed to be provisionally interviewed, therefore, now their results shall be declared.
The petitioner Society has averred that NCTE had granted the aforesaid conditional recognition to the petitioner Society subject to appointment of staff by a duly constituted Selection Committee with the requisite qualification as per norms and standards of NCTE and affiliating University.
Shri Chaudhary has also drawn our pointed attention to the constitution of Selection Committee (Annexure P.13) and has contended that the aforesaid Selection Committee comprised of representatives of Kurukshetra University also. The factum of granting recognition by NCTE to the petitioner Society is even conceded by Shri Vinod S.

Sinhas advocate Sunil Kumar Singh said, Appointments of these 21 principals were made on March 2, 2012. The MU vice chancellor (VC) had filed a false affidavit in the Supreme Court on the basis of which the appointments were made, he said, adding that the VC had filed an affidavit stating therein that five members, including two experts, were in the panel for the appointments, whereas, in fact, the two experts never signed the selection committee list, thereby making the list legally questionable. It may be recalled that an inquiry committee headed by Kumar, a retired IAS officer, had probed the alleged manipulation in the preparation of the panel for the said appointments. However, this was found to be in contradiction to Kumars statement, who earlier said that prima facie, doubtful cases had surfaced during the inquiry. To top it all, simile had become smile for him and fetched full marks to the examinee concerned, he said. Counsel further contends that though due to wrong verification the petitioner was suspended, but after a thorough inquiry, he was reinstated.
